The controversial scandal surrounding gambling streams on Twitch has been almost two years. But just now, Twitch is continuing to fight that fight in court.
Twitch filed a counter-suit after it was sued by James “Phantoml0rd” Varga on February 14. Phantoml0rd streamed gambling content on YouTube and operated gambling games on its website, then received a ban. permanently off Twitch from July 2016.
Varga said Twitch violated the contract between the company and the streamer by not giving him the opportunity to correct his breach under the terms. Twitch said it warned him several times and gave him many opportunities to stop the wrongdoing.
Twitch says Varga was warned 12 months before he was banned. The source said that Varga promoted websites but did not disclose that he participated in investments and arranged gambling results on those websites, but he repeatedly denied this.
Twitch does not mention conversations between former employees Jason “Opie” Babo and Varga in Phantoml0rd’s lawsuit, in which Babo says they allow regulated gambling streams on Twitch. At the time, this was widely believed to be true, as streaming gambling content was quite common. It didn’t stop until the controversy broke out in 2016 when Twitch started taking it seriously.
The lawsuit says Varga was first warned about gambling content in September 2016. As of June 22, 2016 he was temporarily banned, by that time, Phantoml0rd had been warned 9 times. Varga also received allegations that the stream contained “sexual content, self-harming content, and content with stigmatizing symbols.”
After the first time, Varga remained unchanged. On June 25, he continued to stream the $100,000 giveaway through the CSGO Shuffle. Twitch believes that this practice of streaming and giveaway “defrauded Twitch and their users, and could be considered illegal.”
In response to Varga’s lawsuit, Twitch pointed out that his allegations against the company were false. Twich’s reverse lawsuit also requires Varga to compensate for reputation and expenses.
